Welcome to FluidCast. By using our app and services, you agree to these Terms of Service.

Acceptance of Terms

By accessing or using FluidCast, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

Use of Service

You must be at least 13 years old to use FluidCast.
You are responsible for maintaining the security of your account and password.
You agree to use FluidCast only for lawful purposes and in accordance with these Terms.
You may not use FluidCast to distribute malicious content or violate any applicable laws.

Account Registration

To access certain features, you may need to create an account. You agree to provide accurate and complete information and to keep this information up to date.

Purchase Plans

FluidCast offers three purchase options: a Monthly subscription, an Annual subscription, and a one-time Lifetime purchase. Pricing and payment details are presented within the app at the time of purchase. Monthly and Annual subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.

Monthly and Annual Subscriptions

An active Monthly or Annual subscription entitles you to:

Access to all features currently available in FluidCast;
New features and updates as they are released, for the duration of your active subscription; and
Full access to cloud-dependent features, including cloud sync, for the duration of your active subscription.

Cloud feature access ends when your subscription expires or is cancelled.

Lifetime Purchase

The Lifetime purchase grants you a perpetual (lifetime) license to use FluidCast. The following terms apply:

What is guaranteed: Access to the version of the app and the features available at the time of your purchase. The core app — features that run locally on your device — will remain accessible to you regardless of changes to our business.
What is not guaranteed: New features or updates released after your purchase date. These may be made available to Lifetime users at our discretion, but are not an entitlement of the Lifetime purchase.
Cloud-dependent features: Features that require our servers to operate, such as cloud sync, are provided to Lifetime purchasers on a complimentary basis. Because these features involve ongoing operational costs, we cannot guarantee their long-term availability at no additional charge to Lifetime users.
If cloud features change: If we are no longer able to provide cloud features to Lifetime users at no cost, we will provide reasonable advance notice. We will make good-faith efforts to offer alternatives — such as data export tools or self-hosted options — but cannot guarantee the availability or suitability of any such alternative.

Note on the term "Lifetime": The Lifetime purchase refers to the life of the FluidCast product, not the purchaser's lifetime. In practice, the app itself will continue to function on your device regardless of any business changes — it is specifically cloud-dependent services that are subject to our continued operation of server infrastructure.

Content and Intellectual Property

FluidCast provides access to third-party podcast content. We do not own or control this content.
All FluidCast software, design, and branding are owned by FluidCast and protected by copyright and other intellectual property laws.
You may not copy, modify, distribute, or reverse engineer any part of FluidCast without permission.

User Conduct

You agree not to:

Violate any laws or regulations while using FluidCast
Attempt to gain unauthorized access to our systems or other users' accounts
Use automated systems to access FluidCast in a way that disrupts service
Harass, abuse, or harm other users

Disclaimers

FluidCast is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service. We are not responsible for third-party podcast content.

Limitation of Liability

To the fullest extent permitted by law, FluidCast shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

Termination

We reserve the right to suspend or terminate your access to FluidCast at any time for violation of these Terms or for any other reason.

Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with the effective date. Continued use of FluidCast after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of your jurisdiction. Any disputes shall be resolved in accordance with applicable law.
